The Local Court sat last Thursday, and the people of the neighborhoodshowed their interest in the cases to be heard by assembling inconsiderable numbers. Messrs RJ Turner, SMH Davison, JP, and WLillecrapp, JP were on the bench. Four cases under the ImpoundingAct, one of assault, and one on the Civil Side (of disputed account)were disposed of. The only really interesting case that was heard wasGoodes v Giddings, which was an action for 1 pound damages fortrespass by defendent on a section of land near Kersbrook. Thedefendent admitted the fact of his having walked across the section(which was a grass paddock) on the day in question, but pleaded thathe had a right to do so, as he had walked upon a footpath which hadbeen used by the public uninterruptedly for more than twenty years. Two witnesses stated that the section had been brought by the SouthAustralian Company more that twenty years ago, and that the pathwayhad been used ever since by the public on their way to the township ofKersbrook, and especially to Chapel on Sundays, without interruptionof any kind till within the last few months, when the plaintiff put upnotices that trespassers would be prosecuted. The land had not beenfenced during the whole of the twenty years. The plaintiff statedthat the action was brought to try his right, and not for the purposeof obtaining damages. Mr Downer, who appeared for the defendant, contended that the twenty years uninterrupted possession was proved, and that such possession established a right of way for the publicover the path. The Court reserved its decision for a month. Thiscase excited a considerable amount of interest, as in consequence ofthe hilly nature of the country there are many footpaths used in theneighbourhood, and although persons may not object to their neighbourscrossing their grass land, yet it is hardly to be expected that theyshould approve of a right of way being established over it.

(Not sure which Giddings this was, probably one of John's sons as Johnwould have been aged 77 at the time).
